AbideText LLC — Terms of Service

Welcome to Abide, provided by AbideText LLC ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of Abide, a text-message-based Christian companion delivered over iMessage, RCS, and SMS, and any associated website (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please refrain from using the Service.

1.Eligibility and Acceptance

You must be at least 18 years of age to access or use the Service. Abide is not directed to, and is not intended for use by, anyone under 18. By using the Service, you represent and warrant that you are at least 18 years old. Continued use after updates constitutes acceptance of the revised Terms.

2.Use of the Service

You agree not to misuse the Service, including attempting to access data without authorization, interfering with security, using automated scripts to interact with or extract data from the Service, or attempting to circumvent any safety or crisis-response features. You are responsible for the content of any messages you send through the Service.

3.Your Content

You retain ownership of anything you share with Abide, including messages, prayer requests, and personal reflections. By using the Service, you grant us a limited, non-exclusive license to use, store, and process that content solely to operate the Service, respond to you, and maintain the relevant memory and context that makes Abide work. We do not use your content to train general-purpose AI models, ours or any third party's, and we do not use it for advertising. See our Privacy Policy for more detail on how your information is handled.

4.Third-Party Services and AI Providers

The Service is built on and integrates with third-party platforms and AI providers, including Anthropic and OpenAI (which power Abide's conversational responses and certain features such as voice transcription), Linq (which provides messaging infrastructure), Amazon Web Services (which hosts our data), and Stripe (which processes payments). Your use of the Service may be subject to the acceptable use policies of these providers. We do not control, and are not responsible for, the performance, availability, accuracy, or output of these third-party providers, including any outage, error, delay, or unexpected behavior originating from Anthropic's, OpenAI's, or any other third-party AI provider's systems, infrastructure, or models.

5.Fees, Payments, and Refunds

Abide offers a free trial period, followed by optional paid subscription tiers, and a limited free tier. By starting a trial or subscribing, you authorize us and our payment processor, Stripe, to charge your chosen payment method on a recurring basis until you cancel.

If a free trial is offered, you must cancel before it ends to avoid being charged. Unless you cancel before the trial period ends, your trial will automatically convert into a paid subscription and your payment method will be charged.
Subscriptions renew automatically at the end of each billing period unless canceled beforehand.
You can cancel at any time; cancellation stops future renewals but does not entitle you to a refund for the current billing period unless required by law.
Unless expressly stated otherwise, all purchases, fees, and charges are final and non-refundable.
We may, at our sole discretion, issue a one-time refund or credit in limited situations, such as a duplicate charge or a verified technical error. Any such accommodation does not create an obligation to do so again.
You are responsible for any applicable taxes.
We may change subscription pricing or features with reasonable notice.

6.AI-Generated Content: What Abide Is, and What It Isn't

This section is important. Please read it carefully.

6.1 Abide's Responses Are AI-Generated

Abide's responses, including any Scripture references, encouragement, prayers, explanations, or suggestions, are generated using artificial intelligence models provided by third parties, including Anthropic and OpenAI. While we have built Abide to quote Scripture accurately from verified source text where possible and to encourage sound, historically orthodox Christian teaching, AI-generated systems can produce responses that are incomplete, inaccurate, poorly phrased, or otherwise unexpected. Abide's own commentary, encouragement, and conversational responses are not Scripture, are not a substitute for Scripture, and should not be treated with the same authority as Scripture, regardless of how they are phrased.

6.2 No Warranty of Accuracy

We do not warrant or guarantee the accuracy, completeness, timeliness, or appropriateness of any AI-generated content, including theological, spiritual, emotional, or practical content. You are responsible for evaluating any information Abide provides and for seeking qualified human guidance, whether pastoral, medical, legal, financial, or otherwise, for any matter of real consequence.

6.3 No Medical, Psychological, or Professional Advice

Abide is not a substitute for professional medical, psychiatric, psychological, or therapeutic care. Nothing Abide says should be treated as a diagnosis, treatment plan, or professional recommendation. If you are experiencing a mental health crisis, please seek professional help immediately.

If you are in danger or considering self-harm, call 911 (or your local emergency number) right away. In the U.S., you can also call or text 988 to reach the Suicide & Crisis Lifeline. Abide is designed to share these resources when appropriate, but it is not a crisis service, and you should not rely on it as one.

6.4 No Substitute for Church, Pastoral Counsel, or the Holy Spirit

Abide is built to point you toward Scripture, prayer, and real Christian community, not to replace them. Abide does not provide pastoral counseling, cannot administer sacraments or formal religious rites, and does not speak with denominational or ecclesiastical authority. For pastoral care, spiritual direction, or serious life decisions, we encourage you to seek guidance from a pastor, counselor, or trusted person in your own life and community.

6.5 Assumption of Risk

You acknowledge that you are interacting with an artificial intelligence system, not a human being, a licensed counselor, or a member of clergy, and that any reliance you place on Abide's output, spiritual, emotional, practical, or otherwise, is at your own risk. You are solely responsible for your own decisions and actions. To the fullest extent permitted by law, we are not liable for outcomes arising from your use of, or reliance on, the Service or any AI-generated content it produces.

7.Communications Consent

By using Abide, you consent to receive text messages from us, including responses to your messages, reminders you have requested, and, if you engage with this feature, occasional messages Abide sends on its own initiative to check in or encourage you (see our Privacy Policy for more detail on how this works). You can ask Abide to reduce or stop unprompted messages at any time in conversation, or text /forget me to stop all communication and erase your data. Standard message and data rates may apply.

8.Privacy and Data Use

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information, and how you can access or delete it, including through the /memory and /forget me commands directly in conversation. By using the Service, you consent to those practices.

9.Termination and Data Retention

We may suspend or terminate your access to the Service at any time, with or without notice, including for violations of these Terms. Upon termination, your right to use the Service ends immediately. We may retain certain information as required by law or for legitimate purposes such as fraud prevention or dispute resolution, consistent with our Privacy Policy.

10.Informal Dispute Resolution

Before filing a claim against us, you agree to first contact us at legal@abidetext.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute informally by contacting you. If a dispute is not resolved within 30 days of submission, either party may proceed with formal proceedings as described in Section 13.

11.Disclaimer of Warranties

The Service, including all AI-generated content it produces, is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that AI-generated responses will always be accurate, complete, or theologically sound.

12.Limitation of Liability

To the maximum extent permitted by law, AbideText LLC and its affiliates, officers, employees, and service providers, including Anthropic and OpenAI, are not liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of data, goodwill, or spiritual, emotional, financial, or other outcomes, arising from (a) your use of or inability to use the Service, (b) any content generated by an artificial intelligence model integrated into the Service, whether provided by Anthropic, OpenAI, or any other current or future AI provider, or (c) any reliance you place on such content. In no event shall our total liability to you for all claims exceed the greater of (i) the amount you paid us in the twelve months preceding the claim, or (ii) one hundred dollars ($100).

Nothing in this section limits our liability for our own gross negligence, willful misconduct, or fraud, or for any other liability that cannot be limited or excluded under applicable law.

13.Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the state and federal courts located in California for any dispute arising from these Terms that is not resolved informally under Section 10.

14.Indemnification

You agree to indemnify and hold harmless AbideText LLC and its affiliates from any claims, losses, or damages arising from your violation of these Terms or misuse of the Service.

15.Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and AbideText LLC regarding your use of the Service and supersede any prior agreements.

16.Changes to These Terms

We may modify these Terms at any time. Updates will be posted here with a revised "Last updated" date. Continued use of Abide after changes take effect means you accept the updated Terms.
